Terms and Conditions
MyPapertrail offers the web application MyPapertrail via Software-as-a-Service (SaaS). This application is an online tool for managing documents and administration. The application is accessible via the website https://www.mypapertrail.io. This means that we provide you with access to the application via the internet. You can use the application through the Website. You cannot download and install the application on your own computer. These are the general terms and conditions that apply to the use of MyPapertrail.
We have the right to change these terms and conditions. If we do, we will publish the amended terms on the Website. By continuing to use the application, you accept the amended general terms and conditions.
1. General
- 1.1 These general terms and conditions apply to every offer and agreement we conclude with you.
- 1.2 If any part of these terms and conditions or the agreement to which they apply is void or voidable, it does not affect the validity of the remaining general terms and conditions or the agreement to which they apply. The void or voided part will be replaced by a provision that as closely as possible follows the content of the void provision.
2. Automatic Processing of Documents Using Artificial Intelligence
- 2.1 In the automatic processing of documents, we use AI. AI only attempts to process the content of the document. We cannot guarantee that the content of the document will be processed correctly. As an end user, you are responsible for the content of the document and should verify whether the content was processed correctly.
- 2.2 Emails sent to your personal 'paperbox' are processed using AI. We also ask AI to provide an estimate of whether this email is a case of fraud (e.g., 'phishing'). This estimate is not binding and cannot be used as evidence in court. You should never rely blindly on this estimate. It is only a tool to help you protect against fraud. You remain solely responsible for checking the content of the email.
- 2.3 We also ask AI to provide an estimate of the confidence in the accuracy of the processing. This estimate is not binding and cannot be used as evidence in court. You should never rely blindly on this estimate.
- 2.4 We cannot guarantee that AI works correctly. We cannot be held liable for damage resulting from the use of AI.
3. Subscription and Termination
- 3.1 For the use of our Web App, you enter into an agreement with us (Subscription). The duration of the subscription (Subscription Period) is agreed upon during the registration process. The Subscription starts from the date agreed upon during the registration process (Start Date).
- 3.2 You can terminate the subscription at any time. Your subscription will end at the end of the current subscription period. No reason is required for termination.
- 3.3 You can also modify the subscription to a different plan. For example, you can upgrade from a free subscription to a premium subscription. You can also downgrade to a cheaper subscription. Your subscription will be modified at the end of the current subscription period. If, in the cheaper subscription, you have the right to fewer documents or storage space than what you already have in your account, you will keep these documents. However, you will not be able to add new documents until you bring the number of documents or storage space back below the limit.
- 3.4 Managing your subscription can be done through the Website. Management includes modifying your subscription, terminating your subscription, changing your payment details, etc.
4. Price
- 4.1 We may adjust the prices and rates of our subscriptions at any time. The price change will take effect 14 days after its announcement.
- 4.2 If you have already subscribed to us, price changes will not be implemented during the Subscription Period. During the Subscription Period, you will continue to pay the initially agreed-upon price. With the (automatic) renewal of your Subscription, the price change takes effect.
- 4.3 A subscription period is always prepaid. You pay for the upcoming period. If you fail to meet your payment obligation, we may block your access to the application until you meet your payment obligation again.
5. Use of MyPapertrail
- 5.1 If you wish to use MyPapertrail, you must register via the Website. You need to register with a valid email address and password. You are responsible for choosing a sufficiently strong password.
- 5.2 You may only create a personal account for yourself. You may not share your account with others. (You can invite others to collaborate and share your documents.) The number of people you can collaborate with is subject to the limits of your subscription.
- 5.3 You must keep your account information and password strictly confidential. You are liable for all actions taken after logging in with the account information and password.
- 5.4 You are responsible for the technical operation and maintenance of your internet connection, internal network, and all other IT systems required for using the Web App according to our system requirements.
- 5.5 We have the right to block a personal account. We do this if we have a reasonable suspicion that one or more personal accounts are in violation of the law or this agreement. Additionally, we reserve the right to impose other consequences on this use.
6. Availability and Maintenance of MyPapertrail
- 6.1 We will do our best to ensure that you can use MyPapertrail for the time that you have a subscription with us. We will strive to make the application available 24 hours a day, 7 days a week. We are responsible for the operation and maintenance of MyPapertrail.
- 6.2 We reserve the right to modify the Web App and change certain features or functionalities of the Web App, remove or add them.
- 6.3 We do not guarantee that the operation of MyPapertrail is flawless. Please inform us immediately if you experience a malfunction, such as an error message.
7. Force Majeure
- 7.1 We are not liable if we cannot fulfill the agreement with you due to force majeure. This also applies if you cannot fulfill the agreement due to force majeure.
8. Confidentiality
- 8.1 We are obligated to keep all your confidential information secret. 'Confidential information' includes all documents and information you have stored in the platform.
9. Intellectual Property Rights
- 9.1 We (or our licensors or suppliers) exclusively own all existing and future intellectual property rights, such as copyrights, trademark rights, model rights, patent rights, source code, and know-how, resting on or arising from MyPapertrail.
- 9.2 You only have the right to use MyPapertrail. You cannot claim the intellectual property rights mentioned in article 9.1. The right to use MyPapertrail is not exclusive, and it is not allowed to transfer or license the right to use MyPapertrail. All information provided by us is solely for individual use.
10. Indemnification and Liability
- 10.1 You indemnify us for all claims from others due to the data you have stored, collected, or processed using MyPapertrail. We are not liable for the content of the data you have stored, collected, or processed within MyPapertrail.
- 10.2 MyPapertrail is not liable for any damage or other adverse consequences due to the use or unavailability of (information on) MyPapertrail. All actions you perform based on MyPapertrail or the information provided by us are at your own expense and risk. Based on those errors or outdated information, no agreement between MyPapertrail and you can be concluded.
- 10.3 We are not liable for damage caused by improper use of MyPapertrail.
- 10.4 If we are nevertheless liable, our liability is always limited to a maximum of the subscription amount for a period of 1 subscription year.
- 10.5 We undertake to ensure careful storage of the data originating from you. We are not liable for damage to or loss of data stored with us or with third parties.
